Underwhelming Conclusion: FDA Still Unable to Ascertain the Cause of Baby Botulism Outbreak

The Food and Drug Administration has posted what critics have characterized as an underwhelming epilogue to the devastating outbreak of infant botulism, which was linked to spore-contaminated ByHeart formula. Despite having traced the contamination with considerable detail, the regulator is still unable to identify the root cause of the outbreak, let alone propose measures to prevent its recurrence. The outbreak, which was identified in early November and declared over by the FDA and CDC on February 26, resulted in 48 infants across 17 states being hospitalized. Several infants are still convalescing months after succumbing to the life-threatening infection. The FDA's investigation meticulously traced the Clostridium botulinum bacteria to eight powdered whole milk lots, which originated from 33 fluid milk lots supplied by Organic West. The powdered milk was produced at a Nevada facility operated by Dairy Farmers of America. However, the agency conceded that although several hypotheses were considered, the investigational findings did not pinpoint the source or root cause of contamination. In the absence of a definitive explanation, the three implicated companies—ByHeart, Dairy Farmers of America, and Organic West—have been deflecting responsibility. ByHeart emphasised that the FDA did not identify any deficiencies in its facilities. Dairy Farmers of America deflected blame onto Organic West, asserting that its processing had passed all requisite tests. Organic West, in turn, stressed that nothing had been proven about its milk. Bill Marler, a lawyer who specialises in food poisoning litigation and represents 25 of the affected families, described the FDA's conclusion as underwhelming. He criticised the lack of clear guidance for consumers or companies, asserting that ByHeart bears ultimate responsibility. "That is ByHeart's product, in ByHeart's can, with ByHeart's name on it, fed to a baby," he wrote. ByHeart has announced that it intends to resume production and is collaborating with a laboratory to develop more sensitive testing for C. botulinum. The FDA's investigation remains ongoing.
