Meta faces record fine as judge declares platform a public nuisance

A New Mexico judge has ordered Meta to pay an additional $567 million, citing the company's failure to warn the public about potential dangers to children. This ruling, which represents the largest penalty ever issued against the social media giant for child safety issues, brings the total fines in the case to $942 million. Judge Bryan Biedscheid characterized Meta as a public nuisance, drawing a parallel between its content delivery systems and industrial pollution. He argued that the harm caused by Meta’s platforms is not contained within the apps but migrates into the real world, impacting families, schools, and law enforcement. Meta, the parent company of Instagram, Facebook, WhatsApp, and Threads, has expressed disagreement with the verdict and intends to appeal. A spokesperson maintained that the company works diligently to ensure user safety and remains transparent about the challenges of moderating harmful content. The lawsuit, which originated in 2023, alleged that Meta’s recommendation algorithms intentionally steered minors toward explicit material and contact with sexual predators. Consequently, the court ordered the creation of a fund to mitigate these wide-ranging impacts. The majority of the $420 million fund is designated for behavioral health programs, while the remainder will support educational training for teachers and health professionals. Furthermore, the judge imposed several operational requirements, including the removal of like counts for users under 18, the implementation of a 90-hour monthly usage limit, and a strict ban on push notifications during school hours and late at night. Meta is currently defending itself against thousands of similar lawsuits across the United States. With another significant trial involving attorneys general from dozens of states scheduled to begin in California next week, the company faces mounting pressure regarding its child privacy and safety practices.
